These Terms of Service ("Terms") apply to the website available at emeraldhaven.ie (the "Site") and any related services provided by Emerald Haven Gardens in Ireland. Please read them carefully. If you do not agree, do not use the Site.

1. Acceptance and eligibility

By accessing or using the Site, you confirm that you have read and understood these Terms and that you agree to be bound by them. If you are using the Site on behalf of a business, club, school, or other organisation, you confirm that you have authority to bind that organisation to these Terms.

Emerald Haven Gardens is a premium Irish online garden centre and knowledge hub. We provide:

• Online browsing of products such as plants, seeds, bulbs, peat-free compost, tools, pots, wildlife habitats, and accessories.
• Irish-specific gardening guidance and educational content, including advice for Ireland’s wet, mild, and often windy climate.

Our guidance is intended to help you make practical choices, but gardening outcomes depend on factors outside our control, including weather, soil type, planting time, exposure, pests, and your care routine. We describe plants and products as accurately as we reasonably can and continually improve the clarity of our information.

3. Accounts and communications

You may be able to contact us, sign up for updates, or place orders using forms and checkout functionality. Where you create an account (if offered), you agree to provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login details and for all activities carried out through your account.

We may send service communications such as order confirmations, dispatch updates, or responses to your queries. Marketing communications, where offered, will be provided only where you have opted in, and you can unsubscribe at any time.

4. Orders, delivery, and returns

4.1 Product availability and descriptions

Product availability can change quickly, especially for seasonal plants, bulbs, and seeds. Images are illustrative and may vary due to seasonal growth stage, natural variation, and light conditions. Sizes and colours may differ slightly from photographs, particularly with living plants. We aim to provide realistic Irish-specific notes (for example wind tolerance for coastal sites and balcony exposure), but these are guidance rather than guarantees.

4.2 Pricing and payment

Prices are shown in euro unless stated otherwise and may include or exclude delivery costs depending on your basket and delivery selection. If taxes are applicable, they will be shown during checkout. Payment must be completed before an order is dispatched. We may refuse or cancel an order if we suspect fraud, misuse, or a breach of these Terms.

4.3 Delivery

We deliver across Ireland using reliable couriers. Priority service may be available across Wicklow and the Greater Dublin Area. Free delivery thresholds may apply to standard parcels and are displayed on the Site and during checkout where available.

Delivery times are estimates and may be affected by peak periods, weather events, or courier network disruptions. Living plants can be affected by extreme weather. If conditions are severe, we may delay dispatch to protect plant quality and your overall success, and we will notify you where possible.

4.4 On arrival and plant care

On receiving plants, you should unpack promptly, check moisture, and protect them from harsh conditions for a short period if required. Many Irish gardens experience sudden wind or heavy rain, so a sheltered spot can help plants settle. If you have concerns, contact us as soon as possible with order details and clear photos.

4.5 Returns and refunds

Returns and refunds depend on the type of goods, the condition received, and applicable consumer rights in Ireland and the EU. Certain goods, including perishable items and living plants, may have limited return options due to their nature and the requirement to keep them in suitable conditions.

If an item arrives damaged or incorrect, contact us promptly so we can assess and offer an appropriate resolution. For non-perishable goods (for example tools, pots, and accessories), you may be entitled to return items in line with applicable rights, provided they are unused and in original condition where required.

Nothing in these Terms limits your statutory rights as a consumer. We recommend keeping your order confirmation and any dispatch communications for reference.

5. Acceptable use

You agree to use the Site lawfully and in a way that does not infringe the rights of others or restrict their use of the Site. In particular, you must not:

If you are unsure about structural safety for balcony planters or fixings, consult a qualified professional.

8. Limitation of liability

To the maximum extent permitted by law, Emerald Haven Gardens will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, or data arising out of or related to your use of the Site or services.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms, the Site, or any purchase will be limited to the lower of:

• the amount you paid to Emerald Haven Gardens in the 12 months preceding the event giving rise to the claim; or
• €100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

9. Indemnification

You agree to indemnify and hold harmless Emerald Haven Gardens from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.

10. Third-party links

The Site may occasionally reference third-party resources for general context. If any links are provided, they are for convenience only. We do not control those sites and are not responsible for their content, availability, or practices. Your use of third-party sites is at your own risk.
